“Streambox”– (Our DJ streaming App)
DJS using our service can stream music online and offline by using our DJ streaming Application- “Streambox” (hereinafter referred to as the “app”). The use of the app shall be governed by the terms of hereunder;
Terms and Conditions
These conditions apply to users of the DJ streaming service. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the app. If you do not agree to be bound by these Terms and Conditions, you should avoid signing up or using the app. Please read these Terms and Conditions carefully before using the app. These terms and conditions shall only apply to your use of the Streambox. You are still be bound by the clauses stipulated in our general terms and conditions. In the event of any conflict between our Terms and Conditions and these DJ Streaming Terms, these DJ Streaming Terms shall apply to your use of the DJ Streaming Service only.
These terms and conditions may be updated by us from time to time without prior notice to you. Any change of terms shall be binding and effective upon posting of the revised Agreement on our website.
Third-party Products
The Streambox is available and useable through third-party DJ hardware and software products. Each third-party product may have its own terms and conditions, which also apply to your use of Streambox. Music Worx shall not be held responsible for any incompatibility of third-party devices or products with Streambox You shall hold harmless Music Worx for any third-party DJ hardware and/or software that do not to support Stream Box. In such situations, Music Worx will attempt to notify all DJs using our services via e-mail as a preventive measure. If you have disabled email communication, you may not receive the notification.
Account
In order to use Streambox, you are required to create an Account which will contain certain personal details and Payment Information. With your account you can stream and play tracks offline with your application; you can connect to a Mix software or simply use our mobile application. Create your own playlists and play them over all devices or mix them live at your event.
When signing up for Streambox, ensure the following:
- all information you submit is accurate and truthful;
- you have permission to submit Payment Information where permission may be required; and
- you will keep this information accurate and up to date.
It is recommended that you do not share your Account details with any third-party. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer or DJ hardware, it is recommended that you do not save your Account details in your internet browser. If you have reason to believe that your Account details have been obtained by another without consent, you should contact Music Worx immediately to suspend your Account and cancel any unauthorised orders or payments that may be pending.
DJ Streaming Fees, Payments and Subscription
Our DJ Streaming app has three subscription plans (the PRO, the Pro+ and the PRO HQ). These subscription plans allow DJs to stream music online and offline. These plans are listed under our website here https://music-worx.com/plans/. Monthly fees and subscriptions are subject to change. Promotional discounts are available from time to time subject to terms and conditions. The subscription month begins on the day of purchase and extends or terminates on the same day of the following month. The subscription renews automatically unless you cancel it before the automatic renewal date. Your subscription will remain active after termination until the current subscription month. There will be no refunds in the event of early termination.
Payments are only acceptable by and through the following means; American Express Card, Visa Card, Master Card, JCB and PayPal (the “method of Payment”). Cash payment, money orders, or checks are not accepted. You agree to pay all fees and charges associated with your purchase(s), any such charges will include ANY APPLICABLE TAXES and shall be at the rate solely based on your territory of purchase. You are responsible for any purchase made by a third party. Kindly note that the only acceptable currencies for payment are the US dollars and Euro.
How it operates
Streambox allows you to listen to complete streams of tracks from the Music Worx content catalogue either online or offline. You can either stream songs directly using our Stream Box app or through the interface of third-party products.
The audio files are made available encrypted offline. These files can only be played or streamed via the Streambox. Playback or streaming via other software is therefore impossible. The files are unusable after termination of a subscription and must be deleted, also to cause unnecessary disk space.
If you buy a subscription again after a break and you have not deleted your files, the files can continue to be used. The cue points, ratings and comments remain stored in the file.
We will inform you as soon as the streams available for your subscription have been used up. You can purchase additional streams at any time. Once your subscription is cancelled for any reason, you MUST immediately delete the Streambox app from your device. You must ensure all encrypted audio files are deleted from your hard disk. We will send periodic reminders to ensure you have deleted the app and all other attachments including encrypted audio files from your device after termination or cancellation. We have our way of finding out if a user has not deleted the app as required, any such failure to delete the app and encrypted audio files shall be treated as a breach of these terms and the user shall be held liable to the full extent of the law. Music Worx is not responsible for content that is not available to you during this period or at any time due to problem with the server, third-party apps or devices, or the loss of right to make certain content available on our website.
Disclaimer
We do not make any warranty or representation that the Website will meet your requirements, that it will be fit for a particular purpose, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of the Service/Website.
Third-party websites with links from the Site have not been verified or reviewed by Music Worx and the use and access of such third-party websites is made at your own risk. All services herein are provided “As Is” and “As Available”.
We will do our best to maintain the operation of the Site for the Service, however, we may need to temporarily suspend the Service for operational reasons (e.g. for repairs, planned maintenance or upgrades). We promise to restore the Service as soon as reasonably possible after any suspension.
Use of the Streambox
The contents streamed via the Streambox are intended for personal use. The use for public performance purposes is only permitted if the event or club operator owner has a separate permission from the copyright company. This additional license is not included with your subscription.
Account sharing is strictly prohibited. We reserve the right to immediately terminate any DJ streaming subscription if we suspect or have reasons to believe account are being shared between and by two Service Users or between service Users and non-Service Users. The decision to terminate your access to the Streambox is at Music Worx’s sole discretion. Music Worx will not disclose any evidence or reason for such termination to the Streambox. In the event of an early termination due to account sharing, there shall be no refund to you for anytime or period left on your subscription.
Charts and Plays
Plays in the Streambox are not applied to the Music Worx charts for charting purposes. Music Worx reserves the right, in its sole discretion, to exclude plays we suspect are gained fraudulently or through foul play. If we believe plays were made by you or you have paid for such play or manipulated our system through unauthorised access to the site, its servers, or any computer or database connected to the Site, for the sole purpose of increasing the revenue share, we shall deactivate your account and blacklist you from using our services in the future. Music Worx will not disclose any information that was the basis for such decisions if required by law or through a subpoena.
Law and Jurisdiction
These Terms and Conditions and the relationship between you and Music Worx shall be governed by and construed in accordance with the laws of Switzerland and you agree to submit to the exclusive jurisdiction of Switzerland.
Entire agreement
These terms and conditions, together with our general terms and conditions, Privacy policies and other terms relating to our other services contained on our website shall be the entire agreement between you and Music Worx.
